Code 1 'Maternity leave' should be used when Statutory Maternity Pay (SMP) is paid to a female employee who has recently, or is about to, have a baby, who has been employed for approximately 9 months before the date the baby is due, and whose average earnings are above the current Lower Earnings Limit for Northern Ireland.

Code 3 'Adoption leave' should be used when Statutory Adoption Pay (SAP) is paid to employees who are adopting a child and are notified that they have been matched with a child or received official notification that they are eligible to adopt a child from abroad and who satisfy the qualifying conditions are entitled to a maximum of 39 weeks SAP.

Code 4 'Shared parental leave' should be used when statutory shared parental leave is given to parents where there is entitlement to Statutory Maternity Pay (SMP), Maternity Allowance (MA) or Statutory Adoption Pay (SAP) and that has been brought to an end by the mother or adopter giving notice to curtail their maternity or adoption leave. The employee must be taking time off work to care for their child.

Code 5 'Paternity leave' should be used when employees take 1-2 weeks of paid leave. This leave must be taken in one go and cannot start before the birth. It must end within 56 days of the birth. The employee must be taking time off to look after the child and be the father, husband or partner of the mother (or adopter), the child's adopter or the intended parent (surrogacy). The employee must have been in continuous employment for at least 26 weeks before the 'qualifying week' (15th week before the baby is due).

Providers who have previously used code 2 'Additional paternity' leave can only apply if the child was due before 5 April 2015. Additional paternity leave has since been replaced by code 4 'Shared parental leave'.

The introduction of shared parental leave means that some employees will, following the birth of their child, take a combination of different forms of leave. To enable higher education providers (HEPs) to return information in such a way that accurately reflects a person’s leave arrangement, a maximum of 3 occurrences can be returned.

Instances of parental leave that span across two reporting periods should be reported in both years.
