HESA subscription fees - Late payment information

HESA, part of Jisc, charges annual subscription fees (Fees) to subscribers. Timely payment of these Fees means that we are able to continue to offer statutory data collection, quality assurance and dissemination services. 

Occasionally, there are cases where subscribers do not pay their Fees on time and in some cases, fail to pay at all. These scenarios place an additional burden on our administrative and finance functions. It is essential that all subscribers comply with their subscription payment obligations. For those subscribers who do not pay Fees on time, we reserve the right to share details of late or failed payment of Fees internally within your organisation, and/or report this, where appropriate, to your Primary Regulator/Funder (as defined in your subscription agreement). 

 

For providers in England 

Providing data to the Designated Data Body (DDB) forms part of your provider’s conditions of registration with the Office for Students (OfS), specifically condition F4. The requirement to pay the Fees (to fund this activity) is covered under condition G3. Both of these conditions form part of your general and ongoing conditions of registration. 

In line with our duties as the DDB for England, we may charge these Fees under section 67(1) of The Higher Education Research Act 2017 (HERA). In addition, the OfS uses payment data reported by us in the exercise of its regulatory functions, including in making judgements regarding a higher education provider’s compliance with conditions of registration. 

HERA gives the OfS enforcement powers to use if it appears to the OfS that there is or has been a breach of one or more conditions of registration. These include the power to impose specific ongoing conditions of registration or to impose a monetary penalty. 

The contractual arrangements between Jisc and your organisation include an obligation that the subscription Fee is paid by the contractual due date. Should your organisation fail to pay that Fee, Jisc may take legal action to obtain those amounts owed, as well as seeking to recover the costs of taking such action. In addition, the OfS will be informed about subscribers who fail to pay and/or fail to respond to us regarding outstanding fees.

For providers in Scotland, Wales and Northern Ireland

In Scotland, Wales and Northern Ireland providing data to us is a mandatory requirement for publicly funded higher education providers. 

The contractual arrangements between Jisc and your organisation include a requirement to pay the subscription Fee to Jisc by the contractual due date. Should your organisation fail to pay that Fee, we may take legal action to obtain those amounts owed, as well as seeking to recover the costs of taking such action.
